Terms & Conditions - the basics

Welcome to The Equity and Advocacy Social Justice Foundation (the "Foundation," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://www.equityinjustice.ca/ (the "Site"), including any content, functionality, and services offered on or through the Site.

Please read these Terms carefully before you start to use the Site.

1. Acceptance of Terms
By accessing, browsing, or using the Site, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found here, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site.

2. Governing Law
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

3. Privacy Policy
Our collection and use of personal information in connection with your access to and use of the Site is described in our Privacy Policy. By using the Site, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

4. Intellectual Property & Use of Content

4.1. Ownership: All content on the Site, including text, graphics, logos, reports, articles, toolkits, images, and software (the "Content"), is the property of the Foundation or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

4.2. Permitted Use: As a social justice organization, we encourage the sharing of our work to further advocacy. You may share, reproduce, or distribute our reports, articles, and toolkits for non-commercial, educational, or advocacy purposes, provided you:

(a) Provide clear attribution to "The Equity and Advocacy Social Justice Foundation."

(b) Do not modify the content in a way that changes its intended meaning or context.

(c) Do not use the Content to imply our endorsement of you or your organization without our express written consent.

4.3. Restricted Use: The Foundation's name, logos, and all related trademarks may not be used without our prior written permission. All other commercial uses of the Content are strictly prohibited.

5. Donation Policy

5.1. Payment Processing: All donations made through the Site are processed by third-party secure payment processors (e.g., Stripe, PayPal). We do not store or collect your payment card details.

5.2. Tax Receipts: The Equity and Advocacy Social Justice Foundation is a non-profit organization incorporated in Ontario, Canada. We are not a registered charity, and as such, donations are not eligible for an official tax receipt for income tax purposes.

5.3. Refunds: All donations are generally non-refundable.

6. Prohibited Conduct

You agree not to use the Site to:

  • Violate any applicable federal, provincial, local, or international law or regulation.

  • Post, transmit, or share any material that is hateful, discriminatory, defamatory, harassing, threatening, obscene, or otherwise objectionable.

  • Promote misinformation, disinformation, or "fake news."

  • Impersonate or attempt to impersonate the Foundation, a Foundation employee, or any other person or entity.

  • Transmit any viruses, worms, or other malicious software.

  • Engage in any activity that disrupts or interferes with the Site or the Foundation's advocacy work.

 

7. User Accounts
If the Site requires you to create an account, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate your account, in our sole discretion, if you violate these Terms.

8. Links to Third-Party Websites
The Site may contain links to other websites. We provide these links only as a convenience, and we do not endorse, and are not responsible for, the content, accuracy, or privacy practices of such third-party sites.

9. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR OR IMPLIED. NEITHER THE FOUNDATION NOR ANY PERSON ASSOCIATED WITH THE FOUNDATION MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR VOLUNTEERS BE LIABLE FOR ANY DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY SITES LINKED TO IT, OR ANY CONTENT ON THE SITE.

11. Indemnification
You agree to defend, indemnify, and hold harmless the Foundation, its directors, officers, employees, and volunteers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

12. Changes to These Terms
We reserve the right to revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
